The Association for a Better New York (“ABNY,” “we,” “us” or “our”) has created this Privacy Policy (the “Privacy Policy”) to explain why we collect particular information and how we will protect your personal information within our website located at the URL www.ABNY.ORG (the “Site”).  The following also discloses our information gathering and dissemination practices for the Site and the activities and services provided on and through the Site (the “Services”).

Your privacy on the Internet is important to us.  In order to fully understand your rights we encourage you to read this Privacy Policy.  This Privacy Policy is effective as of the date set forth above and is only applicable to the Site.  Except as explicitly provided herein, this Privacy Policy does not apply to the practices of entities that we do not own or control or to people that we do not employ or manage.

What information do we collect?

We collect information from you when you register on our Site, fill out a form, transmit comments or communications, contact us through the Site, or receive customer or technical support.

When using the Services or registering on our Site, as appropriate, you may be asked to enter your: name, e-mail address, mailing address, or phone number.  You may, however, visit portions of our Site without giving any personal information.  If you do provide personal information, it must be true, accurate and complete, and all registration and account details (where applicable) must contain your real name, address and other requested details.  You are responsible for keeping your contact information current and accurate.

Please note that when you delete your registered account information (where applicable), we may retain your registration information for a reasonable period of time afterward for the purpose of internal account management and fraud prevention activities.

Our Site is not set up to track, collect or distribute personal information not voluntarily provided by users.  Our Site logs do generate certain kinds of non-user identifying Site usage data, such as the number of hits and visits to our sites.  This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but again, the statistics contain no personal information and cannot be used to gather such information.  We also may use third-party website analytics tools that collect information about visitor traffic on our Site and any mobile applications.

This Privacy Policy covers personally-identifiable information that may be collected on the Site.  This Privacy Policy does not cover information that may be collected by us through any other means other than as described above.  It also does not apply to any unsolicited information you provide through the Site or the Services.  All unsolicited information shall be deemed to be non-confidential, and we shall be free to reproduce, use, disclose and distribute such unsolicited information to others without limitation or attribution.

We have integrated industry standard or better security measures and systems into the design, implementation and day to day operation of the Site and its underlying servers and networks.  Unfortunately, no transmission of data over the Internet, and no system for storage of physical data, is guaranteed to be completely secure.  It may be possible for hackers or other third parties not under our control to intercept or access private communications unlawfully.  While we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit or otherwise provide to us.  Any transmission or other provision of information is done at your own risk.

Cookies are text files, or entries in larger files, utilized to distinguish between visitors to a website, and to track information during multiple visits to a website.  We may use cookies on some parts of the Site to understand the distribution and patterns of unique and repeat visitors to enhance the Site’s accessibility.

The use of cookies is a standard practice among Internet websites.  Most Internet web browsers may be customized to reject cookies, to only accept or reject cookies by user intervention, or to delete cookies.  Rejecting and/or removing cookies, however, may lead to loss of functionality on the pages of the Site that require cookies to function fully.  Additionally, if a user has created a customized version of the Site, the Site may create a cookie that contains the user’s unique identifier and indicator for any custom content modules requested and, if a user elected the “remember me” option for signing in to the Site, the cookie may contain a user’s password.  Deletion of such a cookie could result in the loss of one’s customized ABNY.ORG portal settings.

Web Bugs (a/k/a Web Beacons) [4]

ABNY.ORG does not use web bugs on its web pages or in any html e-mail generated by use of the portal, or otherwise sent from ABNY.ORG, for any purpose other than to identify site performance needs; to ensure compatibility with the technology used by the Site’s visitors, and to generally add and improve the Services offered on ABNY.ORG.

 
Do we disclose your personal identifiable information to outside parties?

We may share your personally identifiable information with trusted third parties who assist us in operating the Site, providing the Services, conducting our business, or servicing you, or to our affiliates or agents, including the ABNY.ORG project sponsors and partners such as Google Inc., and New York City agencies, offices or other government agencies, so long as those parties agree to keep this information confidential.  Examples include fulfilling requests for Services, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), and providing customer service.  We also may share your personally identifiable information with affiliated businesses that we do not control but with which we engage in joint and co-branded offerings, and entities with which we may merge or which may acquire all or substantially all of ABNY’s assets, as customer information likely will be one of the transferred assets.

Additionally, we will share personally identifiable information if we have a good faith belief that: (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, legal process (such as a court order or subpoena), request by law enforcement or governmental authorities; (ii) such action is appropriate to enforce our Terms of Use, or other policies of our Site or the Services, including any investigation of potential violations thereof; (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Site or the Services; or (iv) such action is appropriate to protect our rights, property or safety, or the rights, property or safety of our employees, affiliates, agents, contractors, other users of the Site or the Services, or others.

 
Children

No applications or materials on the Site specifically solicit information from minors or seek to determine whether the visitor is a minor.  Consequently, because such information will not be specifically identified as being from minors, users of the Site should be aware that personally identifiable information submitted to the Site by minors will be subject to being treated in the same manner as information given by an adult.

ABNY strongly believes that parental supervision is an important factor in Internet use by minors.  Therefore, we ask parents to guide their minor children when children are asked to provide any personal information online.  We further ask that children ask for and receive their parent’s permission before providing any information online.

ABNY.ORG provides links to, and may be linked from, other websites.  The existence and/or provision of those links neither constitutes nor implies endorsement of the destination or departure website(s) or of the content, viewpoint, accuracy, opinions, policy(ies), product(s), accessibility or privacy policy of said destination or departure website(s).  Nor does any link between ABNY.ORG and a third-party website imply sponsorship of such website, or the creator of such website.

Intellectual Property

The content of ABNY.ORG’s webpages is copyrighted, and contains some third party images/graphics that are used with permission.  Users are notified, therefore, that one should presume the need to obtain permission from the copyright holder before reproducing or otherwise using images/graphics from this Site.

WE MAY CHANGE THIS PRIVACY POLICY FROM TIME TO TIME, AND RESERVE THE RIGHT TO DO SO WITHOUT NOTICE.  USE OF THIS SITE SIGNIFIES YOUR AGREEMENT TO THE TERMS OF USE AND THIS PRIVACY POLICY.
